SMS Texting Terms of Service
Blue Cross & Blue Shield of Mississippi ("BCBSMS") provides users with the opportunity to interact with BCBSMS via text messages, also known as Short Message Service ("SMS"), for the purpose of receiving communications from BCBSMS about their Plan and obtaining information about BCBSMS services. Participation is voluntary. You are not required to participate in order to purchase goods or services from BCBSMS. When you opt-in to receive text messages, you agree to receive SMS texting notifications from BCBSMS for alerts/reminders, educational health content, information about services and products available to you under your Plan and/or security purposes. Health-related information provided is not meant to replace professional medical advice. Information provided is valid only at the time the text message is sent and may change at a later time. BCBSMS offers these text message programs to provide information or resources on topics including, but not limited to, the following: Alerts/reminders such as billing/payment, claims, coverage, digital tools and communication materials, Healthy You!/Color Me Healthy!, health and wellness tips, medical coverage, medication reminders, digital tools and services available to you under your Plan and health insurance education.
Opt-In or to Begin Text Messaging Services
You may OPT-IN (or subscribe) to BCBSMS’ text messaging service by:
- Texting the word “subscribe” to 232583;
- Agreeing to receive text messages when completing your myBlue online registration; or
- Agreeing to receive text messages when completing your application for insurance.
By opting in, you:
- Acknowledge you are 18 years of age or older;
- Acknowledge you are the authorized user of the mobile device and owner of the mobile phone number provided in the enrollment process;
- Give BCBSMS express permission to send text messages (including auto-dialed, pre-recorded and/or promotional texts) to the mobile number until you tell BCBSMS to stop;
- Agree to receive text messages from BCBSMS even if the registered mobile number is on a do-not-call list or other similar state or Federal list;
- Accept the security risks associated with text messages described below;
- Authorize BCBSMS to use automated technology to deliver text messages to the mobile number to which you have directed BCBSMS to send these text messages; and
- Agree to all other terms and conditions contained within BCBSMS’ SMS Texting Terms of Service.
Opt-Out or to Stop Text Messaging Services
You can text the word STOP to 232583 at any time to stop text messages from BCBSMS. Once received, BCBSMS will promptly process your opt-out request within the time required by applicable Federal regulations. When you submit your opt-out request, you will receive one (1) final message from BCBSMS confirming that you have been removed from our text messaging system. Following the confirmation message, no additional text messages will be sent unless you re-activate your subscription. Fees
BCBSMS does not charge a separate fee for this service. However, message and data rates may apply and be charged to you by your mobile carrier. Message frequency will vary. Please contact your mobile carrier for specific information regarding you mobile plan and text messaging charges. UNDER NO CIRCUMSTANCES WILL BCBSMS BE RESPONSIBLE FOR ANY CHARGES RELATED TO THE USE OF THIS TEXT MESSAGING SERVICE.
User Information
In addition to the information you choose to provide BCBSMS when you opt-in and use our text messaging service, BCBSMS may also collect certain information automatically, such as the type of mobile device you use, your mobile carrier, your mobile device's unique device ID, your mobile operating system, and information about the way you use the text messaging service.
Security and Privacy
BCBSMS is committed to building user trust and confidence by promoting and complying with the use of business practices that help protect the privacy and the security of the customer and their data. Be advised that communications via text message are not secure and there is a possibility that information included in text messages can be intercepted and read by other parties besides the person to whom it is addressed. If you change carriers or change or deactivate your mobile number, it is your responsibility to opt-out of receiving BCBSMS text messages before making any such change.
BY SUBSCRIBING TO AND USING THIS TEXT MESSAGING SERVICE, YOU ACKNOWLEDGE THAT BCBSMS DOES NOT GUARANTEE THE SECURITY OR PRIVACY OF INFORMATION THAT IS TRANSMITTED BY TEXT MESSAGE. YOU FURTHER AGREE THAT BCBSMS SHALL NOT BE RESPONSIBLE FOR ANY HARM THAT YOU OR ANY PERSON MAY SUFFER AS A RESULT OF A BREACH OF PRIVACY OR CONFIDENTIALITY WITH RESPECT TO ANY TEXT MESSAGE SENT TO YOU OR BY YOU TO BCBSMS.
No Warranties and Limitation of Liability
BCBSMS makes no representations or warranties whatsoever regarding text messages. BCBSMS hereby disclaims all warranties, including any implied representations or warranties of merchantability or fitness for a particular purpose.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY AGREE THAT BCBSMS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE OR ANY OTHER DAMAGES, EVEN IF BCBSMS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE OR LOSS, ARISING OR RESULTING FROM OR IN ANY WAY RELATING TO YOUR USE OF BCBSMS’ TEXT MESSAGING SERVICE. THE WIRELESS CARRIERS ARE NOT LIABLE FOR DELAYED OR UNDELIVERED MESSAGES. FURTHERMORE, BCBSMS SHALL NOT BE LIABLE FOR THE ACTS OR OMISSIONS OF THIRD PARTIES, INCLUDING BUT NOT LIMITED TO DELAYS IN THE TRANSMISSION OF MESSAGES.
General Terms and Conditions
BCBSMS reserves the right to update or amend these terms and conditions at any time without notice. Any and all updates to these terms and conditions will be promptly posted and made available on our website located at www.bcbsms.com. BCBSMS may, at its sole discretion, terminate or suspend this text messaging service, in whole or in part, at any time without notice. The information in any message may be subject to certain time lags and/or delays.
